Welcome to the Geospatial Analysis, Inc. website (the “Site”). By accessing or using this Site, you agree to comply with and be bound by these Terms of Use and our Privacy Policy. If you do not agree to these Terms, you may not use the Site.

Geospatial Analysis, Inc. (“Geospatial Analysis,” “we,” “us,” or “our”) may revise these Terms of Use or our Privacy Policy at any time without prior notice. These Terms supplement any separate license, subscription, or service agreement you have with Geospatial Analysis or one of its authorized partners (a “Customer Agreement”). If there is a conflict between these Terms and a Customer Agreement, the Customer Agreement will control. Certain areas of the Site may have additional terms that apply, and in the event of a conflict, those terms will govern your use of that portion of the Site.

Through the Site, you may access software, tools, documentation, data, technical content, customer portals, support resources, forums, reports, and other materials provided by Geospatial Analysis (collectively, the “Materials”).

You may use the Site and Materials solely in connection with your authorized use of Geospatial Analysis products and services. Except as expressly permitted in a Customer Agreement, you may not use the Site or Materials to provide services to third parties, nor may you share, distribute, sublicense, or allow third-party access to the Site or Materials.

The Site, the Materials, and all Geospatial Analysis software, documentation, data, and technical content are confidential and proprietary to Geospatial Analysis unless expressly stated otherwise. Except as allowed under a Customer Agreement, you may not disclose, copy, distribute, or make available any confidential or proprietary information to any third party without our prior written consent.

You may be permitted to submit information, data, files, comments, or other content through the Site (“Submissions”). Geospatial Analysis does not claim ownership of your Submissions. However, by submitting content, you grant Geospatial Analysis a worldwide, non-exclusive, royalty-free license to use, copy, host, store, display, publish, and modify your Submissions in connection with operating and improving the Site and its services.

You represent and warrant that you have all rights necessary to submit your content and grant the rights described above.

Geospatial Analysis reserves the right to remove or restrict access to any Submission at any time.

We reserve the right to monitor use of the Site and Materials and to suspend or revoke access at any time, including for violations of these Terms or applicable agreements.

You are responsible for maintaining the confidentiality of any usernames, passwords, or credentials used to access the Site. You are responsible for all activity that occurs under your account. If you become aware of any unauthorized use or security breach, you must notify Geospatial Analysis immediately.

The Site may include forums, message boards, or community areas. We do not endorse or take responsibility for any content posted by users.

The Site may also include links to third-party websites. Geospatial Analysis does not control or endorse these websites and is not responsible for their content, security, or practices.

Except as expressly stated in a Customer Agreement, the Site and Materials are provided “as is” and “as available,” without warranties of any kind.

Geospatial Analysis disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not guarantee that the Site or Materials will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, Geospatial Analysis shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business, arising from or related to your use of or inability to use the Site or Materials, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
